Terms
These terms describe the general basis on which KomodoWorks discusses and delivers projects. A project begins only when the relevant Agreement and Project Schedule are accepted and the required deposit is received.

Service provider
KomodoWorks is the name used by Kagan Timur, an independent service provider based in Rathmines, Dublin, Ireland. General questions can be sent to [email protected] and sales enquiries to [email protected].
This website provides information and accepts enquiries. It does not create a contract or take payment directly. Before a consumer or business client becomes bound, the project documents will identify the service provider and provide the terms and contact details applicable to that project.
Services and proposals
KomodoWorks provides websites, web and mobile applications, data analytics, and AI integration. The exact scope, deliverables, schedule, responsibilities, and exclusions are set out in a written proposal or Project Schedule.
Starting prices shown on this website are illustrative. The final price depends on the agreed requirements, complexity, integrations, content, and delivery schedule. Documentation and reasonable handover training are included only where stated in the Project Schedule.
Acceptance and payment
Unless the project documents state otherwise, the default payment schedule is 50% before work starts and 50% before final handover. Larger projects may use agreed milestone payments. Invoices are due within 14 days and may be paid through Stripe.
A deliverable is accepted when the client confirms acceptance or does not report a genuine defect within five working days after delivery. Requests for additions or changes are not defects and may require a revised scope, schedule, and price.
Client responsibilities and delays
The client must provide accurate information, lawful content, access, decisions, and feedback needed for the work. Deadlines move when required material or approval is delayed.
If a project becomes inactive for a prolonged period, KomodoWorks may pause it. Restarting will depend on availability and may require revised dates or pricing.
Cancellation and deposits
Unless the Project Schedule states otherwise, either party may end a project for convenience with 14 days' written notice. The client must pay for work completed and non-cancellable third-party costs up to the end date.
If the client cancels, KomodoWorks may retain only the part of a deposit that reasonably covers completed work, administration, committed costs, and genuine scheduling loss. Any remaining balance will be returned.
Consumers entering a distance contract may have a statutory 14-day cancellation right. If a consumer expressly asks for work to begin during that period, they may have to pay for work supplied before cancellation. Statutory consumer rights are not restricted by these terms or by a Project Schedule.
Ownership and third-party material
After full payment, the client owns the bespoke final work created specifically for that project, to the extent stated in the Agreement. The service provider retains ownership of pre-existing and reusable code, frameworks, templates, tools, methods, and know-how.
Open-source software, stock material, fonts, platforms, and other third-party services remain subject to their own licences and terms. The client is responsible for material they supply and must have the right to use it.
Defects, maintenance, and availability
Unless agreed otherwise, KomodoWorks provides a 30-day defect period after final delivery for genuine bugs caused by its implementation. This does not cover new features, content changes, client or third-party changes, hosting issues, or failures outside KomodoWorks' control.
Ongoing maintenance, hosting support, content updates, new features, and service-level or uptime commitments are not included unless separately agreed and paid for.
Confidentiality and portfolio use
Each party must protect confidential information received for the project. KomodoWorks may show publicly available screenshots and describe completed work in its portfolio unless the client has identified the project as confidential in writing. Credentials, private systems, confidential data, and unpublished material will not be disclosed.
Liability
To the extent permitted by law, KomodoWorks' total liability relating to a project is limited to 100% of the total project fees paid or payable. KomodoWorks is not liable for indirect or consequential loss, lost profit, revenue, goodwill, anticipated savings, client changes, client-provided material, or third-party service failures outside its reasonable control.
Nothing in these terms excludes or limits liability for fraud, death or personal injury caused by negligence, or any liability that cannot lawfully be excluded. Consumer rights and remedies required by law remain unaffected.
Irish law and disputes
The parties should first try to resolve a dispute through direct discussion and may agree to mediation. Irish law governs the project and the courts of Ireland have jurisdiction, except that consumers retain any mandatory rights available under the law of their country of residence.
Changes to these terms
The terms applying to a project are those accepted with its Agreement and Project Schedule. Changes to this website do not alter an existing signed agreement unless both parties agree in writing.
